Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Farts with Friends mobile application and website at fartswithfriends.com (together, the "Service"), operated by Steve Letendre ("we," "us," or "our").

On iOS, the app is also marketed as Blip with Friends. Both names refer to the same Service.

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of the Farts with Friends mobile application and website (together, the "Service"), operated by Steve Letendre ("we," "us," or "our").

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility & accounts

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian.

You are responsible for:

  • The activity that occurs under your account.
  • Keeping your sign-in credentials secure.
  • Providing accurate account information.

You may sign in using Google, Apple, phone number, or other methods we support. Each sign-in method is also subject to the provider's terms and policies.

We may suspend or refuse registration if we reasonably believe you do not meet these requirements or if your account poses a risk to the Service or other users.

3. Subscriptions & payments

Certain features require a paid subscription. Subscriptions are billed through Apple's App Store (iOS) or Google Play (Android). We do not collect or store your full payment card details.

Free trials, pricing, renewal, and cancellation are managed through your App Store or Google Play account settings. Refunds are handled according to Apple's or Google's policies, not directly by us.

If your subscription lapses, access to premium features may end until you resubscribe.

4. Your content

"User Content" means audio recordings, titles, descriptions, profile information, ratings, messages, and other material you submit through the Service.

You retain ownership of your User Content. We do not claim ownership of your recordings. These Terms do not transfer copyright or other intellectual property rights in your User Content to us.

You represent that you have the rights needed to submit your User Content and to grant the license below.

5. License you grant to us

To operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, play, distribute, and display your User Content only as needed to provide the Service consistent with the audience and settings you choose.

This license ends when you delete the User Content or your account, except where we must retain copies for legal, safety, backup, or moderation reasons as described in our Privacy Policy.

You are solely responsible for complying with laws that apply to recording other people. Do not record people without any consent required by law in your location. Do not upload recordings of others without permission.

7. Third-party rights

You must respect the privacy, publicity, copyright, trademark, and other rights of others. Do not upload content you do not have the right to share.

8. Prohibited conduct

You agree not to:

  • Harass, bully, threaten, stalk, or humiliate other users.
  • Post hateful, sexually explicit, exploitative, violent, or illegal content.
  • Post content involving child sexual abuse or exploitation (zero tolerance).
  • Share someone's private information without permission ("doxxing").
  • Impersonate any person or entity or misrepresent your affiliation.
  • Infringe intellectual property or other proprietary rights.
  • Spam, scam, or manipulate ratings or leaderboards.
  • Attempt to bypass blocks, reports, or moderation actions.
  • Probe, scrape, or disrupt the Service or its security.
  • Use the Service in violation of applicable law or our Community Guidelines.

9. Community features

The Service includes social features such as friends, groups, invite codes, ratings, leaderboards, public profiles, and the Bliposphere (public community). Content you share with a public or community audience may be viewed, played, and rated by other users.

You choose the audience for each recording. You are responsible for what you share and with whom.

10. Safety, moderation & termination

We provide safety tools including block, report, Help & Support, and our Community Guidelines. We may review reports, temporarily hide content pending review, remove content, or restrict and terminate accounts that violate these Terms or that we reasonably believe pose harm.

We may act on our own initiative or in response to user reports. Enforcement decisions are made at our reasonable discretion. Where available, you may contact support to appeal certain account actions.

You may stop using the Service at any time and may delete your account through the app or our Delete Account page.

We may modify, suspend, or discontinue the Service (in whole or in part) at any time.

We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a notice to support@fartswithfriends.com with:

  • Identification of the copyrighted work.
  • Identification of the material you believe is infringing and where it appears.
  • Your contact information.
  • A statement of good-faith belief and accuracy, and your authorization to act on behalf of the rights holder.

We may remove or disable access to material that we believe infringes copyright and may terminate repeat infringers.

12. Third-party services

The Service integrates with third-party services (such as Google, Apple, Firebase, and app stores). We are not responsible for third-party content, policies, or practices. Your use of those services is subject to their terms.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STEVE LETENDRE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations; in those cases, the above limits apply to the fullest extent permitted.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Steve Letendre and our affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.

16. Governing law & disputes

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New Jersey, and you consent to personal jurisdiction in those courts.

Before filing a claim, you agree to contact us at support@fartswithfriends.com and attempt to resolve the dispute informally.

17. Changes

We may modify the Service or these Terms at any time. If we make material changes, we will provide notice through the Service, by email where appropriate, or by updating the "Last updated" date above. Continued use after changes take effect constitutes acceptance of the revised Terms.
